California’s Lemon Law applies to Certified Pre-Owned vehicles when there’s still an active warranty in place—either from the manufacturer or a dealership. The warranty doesn’t have to be the original one; as long as coverage is valid at the time of purchase, you’re likely protected.

To qualify, you must give the manufacturer a reasonable chance to fix the problem. Additionally, the law covers cars purchased for personal, family, or household use and some business vehicles under 10,000 pounds if the company owns five or fewer vehicles.

What If the Car Was Sold As-Is?

Certified Pre-Owned cars sold “as-is” generally do not qualify for Lemon Law coverage because the buyer assumes the risk of existing defects. However, there are exceptions. If the dealer failed to properly disclose the vehicle’s as-is status or misrepresented the sale, they may still be held liable.
